1. Acceptance of Terms

By downloading, installing, or using NextCatch ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

NextCatch is an event calendar and raid coordination application for Pokémon GO players. The App consolidates publicly available event information into a curated calendar with smart notifications and analysis, and provides remote raid room matching to help trainers coordinate raids. Some features require an optional paid subscription (NextCatch+). Raid coordination features require a free account.

3. Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Subscription Services

4.1 Subscription Terms

NextCatch+ is an optional premium subscription that provides enhanced event analysis, play-style personalization, advanced filtering, and push notifications. Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.

4.2 Free Features

Core event information — including event existence, timing, type, priority, bonuses, and official source links — is always available to all users at no cost.

4.3 Billing and Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

4.4 Refunds

Refund requests are handled by Apple in accordance with their refund policies.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App in any way that could damage, disable, or impair its functionality
• Violate any applicable local, state, national, or international law
• Abuse raid coordination features, including repeatedly joining and abandoning raid rooms
• Provide false or misleading trainer profile information
• Harass, intimidate, or deliberately disrupt other users' raid experience

6. Raid Coordination Features

6.1 Account Requirement

Remote raid coordination requires a free account created via Sign in with Apple and a trainer profile (your Pokémon GO trainer name and friend code). You are responsible for the accuracy of the information you provide.

6.2 Trainer Code Sharing

When you host a raid room, your Pokémon GO friend code is shared with trainers who join your room so they can send you a friend request in Pokémon GO. By hosting a raid, you consent to this sharing. Your friend code is not publicly visible outside of active raid rooms you participate in.

6.3 Reliability and Conduct

NextCatch tracks a reliability score based on your raid participation history. Repeatedly joining raid rooms without readying up, or abandoning raids after committing, may result in a reduced reliability score visible to other users. We reserve the right to limit raid features for users who consistently demonstrate unreliable behavior.

6.4 No Guarantee of Raid Completion

NextCatch facilitates coordination between Pokémon GO players but does not guarantee that raids will be successfully completed. The actual raid takes place within Pokémon GO, which is operated by Niantic. NextCatch is not responsible for in-game outcomes, failed raids, wasted raid passes, or any other in-game consequences.

6.5 Interaction with Other Users

Raid coordination involves limited interaction with other users (seeing trainer names, sharing friend codes, coordinating ready status). NextCatch does not provide chat, messaging, or social networking features. You interact with other users at your own discretion.

7. Intellectual Property

7.1 Our Content

All content, features, and functionality of the App are owned by Borrowed Fire LLC and are protected by intellectual property laws.

7.2 Third-Party Content

The App displays event information sourced from publicly available Pokémon GO announcements and community resources. Pokémon GO is a trademark of Niantic, Inc. Pokémon is a trademark of The Pokémon Company. NextCatch is not affiliated with, endorsed by, or sponsored by Niantic, The Pokémon Company, or Nintendo. All third-party marks are the property of their respective owners.

8. Disclaimers

8.1 Information Accuracy

Event information displayed in the App is sourced from third-party announcements and curated by our team. While we make reasonable efforts to ensure accuracy, we cannot guarantee that all information is complete, current, or error-free. Event details are subject to change by Niantic at any time without notice.

8.2 Not Official

NextCatch is an independent, fan-made application. It is not an official Pokémon GO companion app. Always verify critical event details through official Pokémon GO channels.

8.3 No Warranty

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted access.

9. Limitation of Liability

To the maximum extent permitted by law, Borrowed Fire LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Missed in-game events due to inaccurate or outdated information
• Loss of in-game progress, items, or opportunities
• Service interruptions or notification failures
• Errors or inaccuracies in event data
• Any other intangible losses

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim, or $50 USD, whichever is greater.

10. External Links and Purchases

The App contains links to third-party websites, including official Pokémon GO event pages. We are not responsible for the content, privacy practices, or terms of any third-party sites. For ticketed events, the App links to official ticketing pages — all such purchases are conducted through the publisher's official channels and subject to their terms.

11. Privacy

Your use of the App is also governed by our NextCatch Privacy Policy. By using the App, you consent to our practices as described in the Privacy Policy.

12. Modifications

12.1 To the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time without prior notice.

12.2 To These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by updating this page. Your continued use after changes constitutes acceptance of the modified Terms.

13. Termination

We reserve the right to discontinue the App or any features at any time. If you have an active subscription at the time of discontinuation, you may be eligible for a refund in accordance with Apple's policies.

14. Indemnification

You agree to hold harmless Borrowed Fire LLC and its affiliates from any claims, damages, losses, or expenses arising from your misuse of the App or violation of these Terms.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal dispute, you agree to contact us first and attempt to resolve the matter informally for at least 30 days.

15.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

15.3 Jurisdiction

Any disputes arising from these Terms shall be resolved in the courts located in New York, New York, and you consent to the personal jurisdiction of such courts.

16. General Provisions

16.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.3 Entire Agreement

These Terms, together with the NextCatch Privacy Policy, constitute the entire agreement between you and us regarding the App.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
